The law is stated as at 10 July 2020. Amendment is likely.
The government has made The Health Protection (Coronavirus, Restrictions) (No. 2) (England) (Amendment) Regulations 2020 (SI 2020/719) which amend The Health Protection (Coronavirus, Restrictions) (No. 2) (England) Regulations 2020 (SI 2020/684) - (see previous post of 3 July 2020).
An Explanatory Memorandum accompanies the Amendment.
Yet again, the powers in the Public Health (Control of Disease) Act 1984 are the basis for this secondary legislation.
The amending legislation will
be fully in force on 13 July 2020.
What the amendments do:
This instrument makes a number of changes to Schedule 2 (Businesses subject to
Closures) of the Regulations.
It makes a change to paragraph 12 so that outdoor
swimming pools and waterparks (excluding indoor facilities at water parks) are able
to open. Indoor swimming pools, including indoor swimming pools at spas, and
indoor facilities at water parks, such as fountains, will remain closed.
The instrument deletes a number of paragraphs from Schedule 2 and this enables the following
businesses and venues to re-open on Monday 13 July:
a) Nail bars and salons;
b) Tanning booths and salons;
c) Spas, and beauty salons
d) Massage parlours
e) Tattoo parlours;
f) Body and skin piercing services;
Although the amendment will enable these venues to reopen, supporting guidance will be published to advise against the most high risk close-contact activities taking place.
The instrument changes regulation 4(2) to reflect the opening of outdoor swimming
pools.
