I have added a link to the judgment. Langstaff J ended his judgment by stating:

"This judgment is to the effect that, applying those laws, including the Human Rights Act 1998, a prisoner will not succeed before a court in England and Wales in any claim for damages or a declaration based on his disenfranchisement while serving his sentence."

As a matter of law that must be right. Parliament has stated clearly that serving prisoners do not have the vote. It is lamentable that UK has failed to act upon the European Court of Human Rights ruling in Hirst v UK. Nevertheless, the Representation of the People Act 1983 governs the position unless and until Parliament acts.ObiterJhttps://www.blogger.com/profile/04544226917595022902noreply@blogger.comtag:blogger.com,1999:blog-6110794854146484721.post-3112109222530317982011-02-23T14:07:01.032+00:002011-02-23T14:07:01.032+00:00The latest news is that Greens has sought an appea...The latest news is that Greens has sought an appeal to the Grand Chamber.

Daily Mail gets it wrong on prisoners votes yet again!jailhouselawyerhttps://www.blogger.com/profile/03795278184797990706noreply@blogger.com
